Article 1 Definitions

1.1 General terms and conditions

The general terms and conditions of Breath-Fit, part of Amrani, which are published on the Breath-Fit website at https://breath-fit.nl

1.2 Participant/Student/Pupil/Client

Anyone who is taking or wants to take a yoga class, private class, corporate class, retreat, workshop, session or course.

1.3 Lesson/Session/Workshop/Retreat

That which is organized by Amrani and followed by the participant.

1.4 Website

The Breath-Fit website at https://breath-fit.nl

1.5 Breath-Fit

Where these regulations refer to Breath-Fit, they specifically refer to Breath-Fit, part of Amrani, registered with the Chamber of Commerce under number 68737718.

Article 2 Applicability

2.1 These Terms and Conditions apply to all private lessons, corporate yoga, subscriptions, punch cards, workshops, retreats, courses, and sessions at Breath-Fit, part of Amrani. By participating, the participant agrees to the applicability of these Terms and Conditions.

2.2 These general terms and conditions apply to all agreements in which Breath-Fit, part of Amrani, acts as client and contractor.

2.3 During the term of the agreement, Breath-Fit, part of Amrani, may amend these terms and conditions. The latest version is always the applicable version and is available to everyone on the website.

2.4. These terms and conditions do not apply to classes held at yoga studios and gyms.

The terms and conditions of the yoga studio or gym apply.

Article 3 Own risk and liability

3.1 Participation in the lessons is entirely at your own risk.

3.2 Injuries, mental complaints and pregnancy must be reported before the lesson.

3.3 Breath-Fit, part of Amrani, accepts no liability for material or immaterial damage as a result of any accident or injury to the participant.

3.4 Breath-Fit, part of Amrani, is not liable for loss, embezzlement, theft, or damage, either direct or indirect, of or to the participant's property.

3.5 Damage caused by the participant, whether intentionally or unintentionally or through improper use, to property of Breath-Fit, part of Amrani, must be compensated.

3.6 Breath-Fit, part of Amrani, reserves the right to cancel a class or change its location without giving a reason. The class will be rescheduled or a refund will be issued. This does not apply to classes held in yoga studios and gyms. The terms and conditions of the yoga studio and gym apply.

Article 4 Business sessions

4.1 The manner in which Company Sessions are organised is determined by coordination between the company and Breath-Fit, part of Amrani.

4.2. If the company cancels the session within 48 hours, the agreed amount will be charged.

4.3. The invoice must be paid prior to the service, unless otherwise agreed.

Article 5 Workshop

5.1 Breath-Fit, part of Amrani, reserves the right to cancel a workshop. In that case, the registration fee already paid will be refunded.

5.2 Participants may participate in a workshop/group session after Breath-Fit, part of Amrani, has received the full amount for the workshop. The reservation is only finalized after Breath-Fit, part of Amrani, has received a deposit of at least 40% of the total amount.

5.3 Fourteen to seven days before the workshop/group session, the participant can cancel their registration. In this case, 50% of the registration fee/deposit will be refunded plus a deduction of €7.50 administration costs.

5.4 If the participant cancels within seven days of a workshop, no refund will be made.

Article 6 Retreat

6.1 Participants can participate in a retreat after Breath-Fit, part of Amrani, has received the full amount for the retreat. The place is only definitively reserved after Amrani has received a 40% deposit of the total amount.

6.2 When participating in a retreat, the deposit must be paid within 14 days of booking. The remaining balance must be paid no later than 4 weeks before the scheduled retreat.

6.3 Breath-Fit, part of Amrani, reserves the right to cancel the retreat. In that case, the amount already (partially) paid by the participants will be refunded.

6.4 If an agreement is canceled within 48 hours of the reservation, the traveler is liable for the reservation fee. Other cancellation fees depend on the time of cancellation:

Up to 8 weeks before departure 15% of the travel sum

From 8 weeks to 6 weeks before departure 30% of the tour price;

From 6 weeks to 4 weeks before departure 50% of the travel sum;

From 4 weeks to 2 weeks before departure: 75% of the tour price; From 2 weeks to the day of departure: 100% of the tour price.

6.5 If the participant is unable to attend the retreat on site for any reason, any costs already paid will not be refunded.

Article 7 Online Course

7.1 The participant will receive access to the online course after registration and payment for the course.

7.2 The participant must complete the information truthfully.

7.3 The course can be used for a minimum of 6 months.

7.4 Breath-Fit, part of Amrani, is in no way liable or liable for any damages arising from, or resulting from, the (temporary) unavailability or (interim) cancellation of the course. Participants are responsible for purchasing and ensuring the proper functioning of their internet connection.

7.5 Breath-Fit, part of Amrani, has the right to remove (parts of) the course if it deems this necessary.

7.6 The participant may not download, copy, transfer, reproduce, edit or distribute the course material in any way or form.

Article 8 Subscription, strip card, single lesson, private lesson, session and prices

8.1 Breath-Fit, part of Amrani, reserves the right to cancel a class. In this case, the class will be rescheduled after consultation, or the amount already paid will be refunded.

8.2 A subscription or strip card is strictly personal and non-transferable.

8.3 Participants are responsible for attending classes. Missed classes are not eligible for a refund, unless otherwise agreed.

8.4 The cancellation period for all subscriptions is one month. Cancellation must be submitted by email to Breath-Fit, part of Amrani, at info@breath-fit.nl.

8.5 A strip card is valid for 6 months, unless otherwise agreed.

8.6 The fee for a single lesson must be paid in advance in cash, via an online payment request, iDEAL, or bank transfer, unless otherwise agreed. Payment by card (before or after the lesson) is also possible upon request.

8.7 Private lessons must be paid for in advance in cash, via an online payment request, iDEAL, or bank transfer, unless otherwise agreed. Payment by card is also possible upon request (before or after the session).

8.8. It is possible to cancel a private lesson or session free of charge up to 24 hours before the start of the lesson.

This can be done by email, WhatsApp, or phone. If the participant cancels their reservation within 24 hours of the start date, no refund will be given, unless otherwise agreed.

Article 9 Prices

All current prices are listed on the website www.Breath-Fit.nl. Amrani reserves the right to change prices.

Article 10 Personal data

10.1 Breath-Fit, part of Amrani, collects personal data from its participants/clients to maintain its records, process payment orders, and for administrative purposes. Breath-Fit, part of Amrani, handles this personal data with care, as stated in the Breath-Fit, part of Amrani, privacy policy, which can be found on the website https://breath-fit.nl/privacyverklaring/

Article 11 Medical Disclaimer

11.1 The activities we offer are not intended to replace necessary medical treatment. Always discuss any physical and/or psychological complaints with a doctor before booking a class or session.

11.2 If you have any physical complaints, these must be reported prior to the lesson/session.

11.3 Participants are expected to take physical complaints seriously and not force anything. Participants are responsible for this themselves.

Article 12 Applicable law and competent court

12.1 Dutch law applies to the legal relationship between Breath-Fit, part of Amrani, and its participants.

12.2 All disputes that may arise between Breath-Fit, part of Amrani, and the participant will be submitted to the competent court.

Article 13 Complaints procedure

13.1 If the participant has a complaint, please send it with a reasoned explanation to info@breath-fit.nl. The complaint will be processed within 5 business days of receipt, if reasonably possible.

13.2 Participants have the option to submit a complaint to the Dispute Resolution Committee via the European ODR Platform, which can be found at http://ec.europa.eu/consumers/odr/.
